The Fair Pint Campaign has welcomed the Government’s announcement that it will revoke the land Agreements Exclusion and Revocation Order which is one of the legal obstacles which have prevented proper scrutiny of ‘pubco’ leases by the competition authorities.
Fair Pint have worked with CAMRA and other members of the IPC to put pressure on the Government to take action to revoke the order.
The removal of the order which will happen in April next year a small bit of good news for the pub sector as it does lift a significant barrier to future regulatory intervention in the sector.
The removal of the order is the beginning of the dismantling of the legal structure which has allowed companies who own leased pub estates to wreak havoc on the pub sector unimpeded.
The new requirements for pub owning companies to ensure that their agreements aren’t anti-competitive through a process of providing a self assessment about the impact of their lease agreements will open them to future challenges.
Fair Pint were over in Brussels last year along with the GMB to lobby MEPs and the European Commission on the reforms to the Block Exemption which gives pub companies protections from EU competition law.
